1. Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the website, content, features, tools, products, and services offered by AK & Co. Jewelers ("we," "us," or "our"), including any purchase you make through our online store (collectively, the "Services").

By accessing or using the Services, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy and Return, Refund & Exchange Policy, each of which is incorporated into these Terms by reference.

If you do not agree to these Terms, please do not use the Services.

If there is a conflict between these Terms and our Privacy Policy, the Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

If there is a conflict between these Terms and our Return, Refund & Exchange Policy, the Return, Refund & Exchange Policy controls with respect to returns, refunds, and exchanges.

2. Who We Are

AK & Co. Jewelers is an independent reseller of pre-owned luxury watches and fine jewelry, based in Florida.

Our store is hosted on Shopify, which enables us to provide the Services to you.

3. Brand Affiliation Disclaimer

We are not an authorized dealer, agent, or representative of any brand or manufacturer whose products appear on this site, including but not limited to Rolex, Patek Philippe, and Audemars Piguet.

All brand names, model names, logos, and trademarks referenced on this site are the property of their respective owners and are used solely to identify and describe the pre-owned products offered for sale.

No affiliation with, sponsorship by, or endorsement from any manufacturer is claimed or implied.

Because we are not an authorized dealer, products sold by AK & Co. Jewelers may not be eligible for manufacturer warranties, and any manufacturer warranty coverage is not provided, transferred, or guaranteed by us.

Where original warranty cards or papers accompany a piece, they are included as part of the item's documentation, and any remaining manufacturer coverage is subject to the manufacturer's own terms and verification.

4. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services or place an order.

By using the Services, you represent that you meet this requirement and that any information you provide to us is accurate and complete.

5. Products and Listings

Our inventory consists of individual pre-owned pieces. Each listing describes a specific item, including its condition, included accessories, and documentation.

Because these are pre-owned goods:

• Items may show signs of prior ownership consistent with their described condition, including light surface marks, oxidation, and expected patina.
• Included accessories such as boxes, papers, warranty cards, links, and straps are listed per item. If it is not listed, it is not included.
• Listing photographs may be stock or representative images of the model rather than the specific item for sale. The written description in each listing controls what you will receive.
• Additional photographs of the specific item are available on request before purchase.
• Listings are for single, unique items. Once an item sells, it is no longer available, and we cannot guarantee that a comparable item will be offered.

We make reasonable efforts to describe every item accurately. If an item you receive is materially different from its listing, our Return, Refund & Exchange Policy sets out your remedy.

6. Orders, Payment, and Cancellation

Placing an order constitutes an offer to purchase. All orders are subject to acceptance by us.

We may decline or cancel any order where we reasonably suspect fraud, payment cannot be verified, an item is unavailable, or a pricing or listing error has occurred.

If we cancel an order after payment, we will issue a full refund to the original payment method.

• Payment is due in full at the time of purchase using the payment methods offered at checkout.
• You represent that you are authorized to use the payment method provided and that your billing information is accurate.
• For higher-value orders, we may require additional identity or payment verification before shipment.
• Cancellation requests before shipment are honored at no charge. After shipment, an order is treated as a return under our Return, Refund & Exchange Policy.

7. Pricing and Errors

All prices are stated in U.S. dollars and exclude applicable taxes and shipping unless stated otherwise at checkout.

If an item is listed at an incorrect price because of a typographical or technical error, we reserve the right to cancel the order and issue a full refund.

We may also contact you with the correct price and offer you the choice to proceed or cancel.

8. Shipping and Risk of Loss

Every shipment we send is fully insured and requires an adult signature on delivery.

Shipping timelines shown at checkout are estimates and begin when the order clears payment and any required verification.

Title to an item passes to you upon our delivery of the package to the carrier. Because every shipment is insured, claims for loss or damage in transit are handled through our Return, Refund & Exchange Policy.

We will manage carrier and insurance claims on your behalf as described in that policy.

You are responsible for providing an accurate shipping address and for ensuring that an adult is available to sign at delivery. We are not responsible for delivery failures caused by an incorrect address you provided.

9. Returns, Refunds, and Exchanges

Returns, refunds, and exchanges are governed by our Return, Refund & Exchange Policy, available on this site.

Please review it before purchasing. Key points include category-specific return windows, condition requirements, final-sale categories including custom and wholesale transactions, and required return procedures including authorization before shipping any item back.

10. Sell and Trade Submissions

If you submit an item to us for sale or trade consideration, you represent and warrant that you are the lawful owner of the item, that it is free of liens and encumbrances, and that you have the full right to sell or trade it.

Any offer we extend is contingent on our physical inspection and verification of the item, and we may revise or withdraw an offer if the item received differs from its description.

We reserve the right to decline any item for any reason, and to comply with any applicable holding, reporting, or recordkeeping requirements under Florida secondhand dealer law.

11. Acceptable Use

You agree not to misuse the Services. Among other things, you agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to interfere with, compromise, or disrupt the Services, including by introducing malicious code or attempting unauthorized access.
• Use any automated system to access the Services, scrape content, or place orders.
• Impersonate another person, misrepresent your affiliation, or provide false information in connection with an order or account.
• Resell or offer any content from the Services without our written permission.

We may suspend or terminate access to the Services for violations of these Terms.

12. Intellectual Property

Other than third-party trademarks identified in Section 3, all content on the Services, including our name, logo, site design, text, photographs, and product descriptions, is owned by or licensed to us and is protected by intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent, except for your own personal, non-commercial use in connection with shopping on the Services.

13. User Content and Reviews

If you submit reviews, comments, photographs, or other content to the Services, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services and our marketing.

You represent that your content is accurate, that you own or have the rights to it, and that it does not violate any law or the rights of any third party.

We may remove any user content at our discretion.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or secure.

Nothing in this section limits any right or remedy expressly provided in our Return, Refund & Exchange Policy or any right you have under applicable law that cannot be disclaimed.

16. Limitation of Liability

To the fullest extent permitted by law, AK & Co. Jewelers and its members, managers, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data arising out of or related to your use of the Services or any product purchased through them.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to us for the product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless AK & Co. Jewelers and its members, managers, officers, and employees from and against any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your violation of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

Before filing any claim, you agree to first contact us at Info@akandcojewelers.com and give us a reasonable opportunity to resolve the dispute informally.

19. Changes to These Terms

We may update these Terms from time to time.

Changes take effect when posted, and the version in effect on the date of your purchase governs that order.

Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

We encourage you to review this page periodically.

20. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.

Our failure to enforce any provision is not a waiver of it.

These Terms, together with our Privacy Policy and Return, Refund & Exchange Policy, constitute the entire agreement between you and us regarding the Services.

You may not assign your rights under these Terms without our consent; we may assign our rights in connection with a sale or reorganization of our business.
